Un tribunal de Liverpool ha condenado a cuatro miembros de una familia británica con penas de cárcel como consecuencia de una reclamación falsa contra el touroperador ‘Jet2 Holidays’ tras su estancia en un hotel de Benidorm en el verano de 2015.

Según fuentes de la cadena hotelera donde se hospedaron, los cuatro turistas presentaron una reclamación contra el mayorista, al que reclamaban una compensación de unos 50.000 euros por una supuesta intoxicación alimentaria ocurrida en el hotel Aqua Magic Rock Gardens de Benidorm, perteneciente a la cadena Magic Costa Blanca

La supuesta intoxicación la habrían contraído en junio de 2015 mientras pasaban sus vacaciones en el complejo hotelero, según recoge también el medio especializado TTG.

Los cuatro turistas, Michael Jameson, Claire Weir, Jane Weir y Janet Weir, aducían que aquellos días habían sufrido náuseas, diarreas, vómitos y dolor de estómago, y apoyaban su versión con varios informes médicos que lo confirmaban.

No obstante, el tribunal de Liverpool ha concluido que en los mismos días en que supuestamente estaban intoxicados realizaron varias publicaciones en redes sociales ilustrándolas con frases como «las mejores vacaciones» o «disfrutando cada minuto» y dichos mensajes iban acompañados con imágenes en las que se les veía consumiendo diferentes bebidas alcohólicas.

Ante tales evidencias, cada uno de los cuatro miembros ha sido condenado a tres meses de prisión y a pagar 842 euros, aunque la condena ha quedado suspendida por dos años, de manera que si no cometen ningún delito en ese tiempo y cumplen con los pagos, no tendrán que entrar en la cárcel.

Fuentes de la cadena Magic Costa Banca han indicado al respecto que «siempre» mantuvieron «que era una denuncia falsa porque los alimentos cumplen con todas las garantías de salubridad».

Según estas fuentes, la familia de británicos actuó movida por «la posibilidad de conseguir unas vacaciones gratis y un dinero extra: Se trataba de una táctica contra la que ya están actuando los tribunales británicos».

Por su lado, el director ejecutivo de Jet2 Holidays, Steve Heapy, ha asegurado en el portal TTG que su compañía había advertido durante mucho tiempo sobre «las consecuencias graves de hacer denuncias falsas» y ha considerado que la decisión del tribunal «demuestra lo serias que pueden ser».

In the face of such evidence, each of the four members has been sentenced to three months in prison and pay 842 euros, although the sentence has been suspended for two years, so that if they do not commit any crime in that time and pay, they will not have to go to jail.

Sources of the Magic Costa Banca chain have indicated that they «always» maintained «that it was a false report because the food meets all the guarantees of health».
